Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SightEcho mobile application ("App") and related services (collectively, the "Service") provided by SightEcho ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App is not directed to children under 13, and we do not knowingly permit such use.

2. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to keep it current. We may suspend or terminate accounts that violate these Terms or appear to be operated fraudulently.

3. Description of Service

SightEcho provides AI-powered image analysis and audio narration based on photos you submit. The Service uses third-party AI providers (including but not limited to Google Gemini) to generate textual and audio content. The Service is supported in part by advertisements served through Google AdMob, in addition to in-app purchases. Analysis results are informational and entertainment-oriented; they may not always be accurate, complete, or up to date, and should not be relied upon for medical, legal, financial, navigational, or other safety-critical decisions.

4. Credits and In-App Purchases

• Credits are a virtual unit used to access certain features (analysis, audio narration). Credits have no monetary value, are non-transferable, and cannot be exchanged for cash.
• Signup bonus credits are granted at no charge upon account creation and are subject to the policies described in the App.
• Purchased credits are processed by Apple App Store or Google Play. Pricing, taxes, and refund policies are subject to those platforms' terms. Refund requests are handled directly by Apple or Google through their respective support channels (Apple / Google Play).
• Ad-reward credits are granted upon completed advertisement viewing and expire 24 hours after grant. Ad-reward credits are limited to general analyses and are subject to anti-abuse controls, including rate limits and Server-Side Verification (SSV).
• Except where required by applicable law (including consumer protection laws in your jurisdiction), credit purchases are non-refundable once the credits are added to your account.
• We may modify credit costs, signup bonuses, ad-reward amounts, or pricing tiers at any time. Existing purchased credits will not be revoked, but their utility (e.g., what features they unlock) may change.

5. User Content

You retain ownership of photos you upload ("User Content"). By uploading, you grant us a limited, worldwide, non-exclusive license to process, store, and analyze the User Content solely to provide the Service to you. We do not use your photos for advertising or to train AI models. You represent that you have all necessary rights to the User Content you upload and that it does not infringe on the rights of others.

6. Acceptable Use

You agree not to:

• Upload content that is illegal, infringing, defamatory, obscene, or that depicts other persons without their consent;
• Reverse engineer, decompile, or attempt to extract the source code of the App;
• Use the Service to develop a competing product or to scrape or copy our content;
• Circumvent rate limits, abuse promotional credits, create multiple accounts to obtain bonuses, or otherwise exploit the Service;
• Use the Service to harass, harm, or impersonate others;
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

7. Intellectual Property

The App, including its software, design, branding, and AI-generated content delivered to you, is owned by SightEcho and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

8. Termination

You may stop using the Service at any time and delete your account from within the App. We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or for security or legal reasons. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, governing law) will survive termination.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or reliable. AI output may contain inaccuracies, omissions, or so-called "hallucinations." You are solely responsible for any decisions made based on Service output, and you agree not to use the Service for medical, legal, financial, navigational, or other safety-critical purposes.

10. Limitation of Liability

To the maximum extent permitted by law, SightEcho and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or USD $50, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless SightEcho and its operators from any claims, damages, liabilities, and expenses arising from your use of the Service, your User Content, or your violation of these Terms.

12. EU/UK Consumer Withdrawal Right (Digital Content)

If you are a consumer in the European Economic Area or the United Kingdom, you ordinarily have the right to withdraw from a purchase within 14 days. By initiating a credit purchase and using any portion of the credits, you expressly request immediate performance of the contract and acknowledge that you lose your right of withdrawal once the credits are delivered to your account and you begin using the Service. Statutory rights that cannot be waived by contract remain unaffected.

13. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following terms also apply:

• These Terms are between you and SightEcho only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its contents.
• The license granted is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, in accordance with Apple's Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• SightEcho, not Apple, is responsible for any product warranties, claims (including product liability, legal compliance, and consumer protection), and third-party intellectual property infringement claims.
• You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Google Play Additional Terms

If you obtained the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. SightEcho, not Google, is responsible for the App and any claims arising from it.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the App or by email to your registered address. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, except where mandatory consumer protection laws of your jurisdiction provide otherwise (in which case those mandatory rules and your local courts apply to the extent required).

17. General Provisions

• Entire Agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and SightEcho regarding the Service and supersede any prior agreements.
• Severability: if any provision is held unenforceable, the remaining provisions remain in full force and effect.
• No Waiver: our failure to enforce any provision is not a waiver of that provision.
• Assignment: you may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: we are not liable for any delay or failure caused by circumstances beyond our reasonable control, including natural disasters, network outages, or third-party service failures.
